LCK Privacy Notice

Last updated: Feb 17, 2025

Hey there! Thanks for visiting! LIV Inc. offers cool VR tools and tech that let you share your virtual reality adventures with your friends, family, and fans. This Privacy Notice explains what personal data we collect from and about end users of the LIV Creator Kit (“LCK”, for short). It also tells you about your rights when it comes to your personal data (which depend on the laws where you live).

What is Personal Data?

Personal data is just about any info about you that can be used to identify you, like your name, email or phone number.

Under data protection laws like the European Union’s General Data Protection Regulation (“GDPR”), LIV Inc. is the “controller” or company responsible for handling your personal data.

By using the LCK, you agree that you’ve read and understood this Privacy Notice. You should also check out any other rules and agreements related to our services, like the LCK License Agreement and the general Privacy Notice.

NOTE FOR MINORS:

To use the LCK, you need to be at least 13 years old. If you’re under 18, but at least 13, you’ll need permission and supervision from a parent or guardian.

What Information Do We Collect and How?

We collect different types of information from you. Here’s how we get it:

Information You Give Us Directly
  • When You Contact Us: If you reach out to us by email, chat, or social media, we might collect details like your contact info, the reason for your message, and any transcripts or recordings of the conversation.
  • When You Share Content (Like Videos): If we let you create and share VR videos or other content creating using the LCK, we may collect information like your image, voice, and movements associated with the videos or other content you choose to share.
Information We Collect Automatically

We also collect info automatically when you use our services, like:

  • Device and Game Info: We keep track of which VR headset you’re using, which game you’re playing with our LCK (and which version of the game), the name of the game developer, and a random code that’s linked to your device or app. This code doesn’t tell us who you are.
  • Location Data: Depending on how the game is set up, we might collect information about the area you’re in, like your city.
  • Your Activity: We track how you use our products, such as which games you play and for how long.
  • Crash Reports and Errors: If the app or device crashes, we collect basic information about what went wrong to help us fix bugs.
How We Use Your Info

We use the information set out above to:

  • Fix bugs and make our products even better;
  • Understand how you and others use our products, so we can improve them;
  • Manage early access tests (like beta testing) and collect feedback;
  • Respond to your questions and listen to your feedback and suggestions;
  • Protect you and other users from any harmful activities or mis-use of our services; and
  • Meet any other goals we tell you about when we collect your info.
Who We Share Your Personal Data With

Sometimes, we might share your personal data, including with:

  • Other LIV Inc. companies: We may share your data with other companies connected to us (like parent companies or subsidiaries).
  • Service Providers: We might share your info with companies that help us with things like hosting or storage services.
  • If we Sell or Merge with Another Company: If something big happens like a merger or sale, your info might be shared with the new company.
  • When the Law Requires it: If we’re asked by a court or another authority, we may need to share your data to follow the law or protect our rights.
  • With your Permission: Sometimes, we might ask if it’s okay to share your personal data in a certain way. If you say yes, we’ll go ahead and share it that way.

We might also share information that doesn’t personally identify you, such as overall usage statistics (e.g., how many people have used the LCK, how many recordings have been made). We typically share aggregate information like this with our developer community and business partners.

Our Legal Bases for Using Your Data

Sometimes, the law requires us to explain why we handle your data. Here’s why we do it:

  • Legitimate Interests: In most cases, we handle your personal data because it’s important for things like:
    Giving you the best service
    Marketing and advertising
    Improving our business
    Legal and ethical Matters
  • Contractual Obligations: We also process data to meet the agreements we make with you, like when you sign up for LIV Inc. services.
  • Consent: In certain cases, we ask for your consent to use your personal data, and you can change your mind whenever you want.
Your Rights and Choices

Depending on where you live, you may be able to:

  • Ask to see your personal data
  • Request updates to it
  • Request deletion
  • Ask us to stop processing your data in certain situations.
  • Ask us to not sell or share your personal data (but just so you know, we don’t sell or share the data we collect when you use the LCK, as those terms are legally understood).

If you want to request any of this, contact us and we’ll do our best to help.

Children
We don’t intentionally collect personal data from children under 13. If you’re a parent or guardian and think your child gave us personal data without your permission, let us know at privacy@liv.tv.

Third-Party Game and App Developers
The LCK is made to work with other games and apps. Our Privacy Notice doesn’t cover those games or apps. Some games or apps you use that include the LCK may also collect or share your information. Make sure to check their privacy notices to understand how they handle your info.

Where Your Data Goes
Your data might be stored and processed in the United States or in other countries where LIV Inc. operates. Some of these countries might have different data protection laws, but we take steps to make sure to keep your data safe wherever it goes.

How Long We Keep Your Data
We only keep your personal data as long as necessary for our services or to meet legal requirements. Once it’s no longer needed, we may anonymize or delete it.

How We Protect Your Data
We use security measures to protect your personal data from being lost or mis-used. But remember, no system is 100% secure, so there’s always a small risk when sharing personal data online.
